Illinois Commerce Commission Authority

Intrastate operating authority for Illinois carriers — applications, insurance filings and ongoing compliance.

Federal operating authority covers interstate commerce. If you are hauling for hire entirely within Illinois — picking up in Chicago and delivering in Peoria, never crossing a state line — that is intrastate commerce, and it is regulated by the Illinois Commerce Commission instead.

This trips up a lot of carriers. Having an MC number does not authorise purely intrastate for-hire movements inside Illinois, and plenty of operators discover the gap only after an enforcement stop. Conversely, some carriers apply for ILCC authority they do not actually need because everything they run crosses a state line.

ILCC Authority — frequently asked questions

Do I need ILCC authority if I already have an MC number?

Possibly. MC authority covers interstate for-hire transportation. If any of your for-hire movements begin and end within Illinois without crossing a state line, those are intrastate and fall under Illinois Commerce Commission jurisdiction. Many carriers legitimately need both.

What if I only haul my own goods within Illinois?

Private carriage — hauling your own property as part of your own business rather than for hire — is treated differently from for-hire carriage. The distinction matters and is worth confirming for your specific operation rather than assuming, because the penalty for guessing wrong falls on you.

What insurance does the Commission require?

The Commission requires proof of liability coverage at minimum levels that vary by the type of operation and, for some categories, cargo coverage as well. Your insurer files the proof directly with the Commission on the required forms — a certificate of insurance sent to you is not the same thing and will not satisfy the requirement.

How long does ILCC authority stay valid?

Authority remains in effect as long as you maintain the required insurance on file and stay in compliance. A lapse in the insurance filing is the most common reason authority gets suspended — and it usually happens because a policy was changed or renewed and the new filing never went in.
